    An Open Letter to Hawaii’s Governor-Elect Neil Abercrombie
    Dear Governor-Elect Abercrombie,

    I am writing to formally invite you to issue the first “pre-trial pardon” in American history, to effect the immediate release of Reverend Roger Christie, before Thanksgiving Day. He has been held in federal prison in Honolulu since July 8th, been denied bail four times, and had his trial postponed until next April. For Roger Christie to remain in prison on Thanksgiving would be an egregious insult to the inconceivable sacrifices made by previous generations to secure the American freedoms that are our primary obligation to defend.

    As the responsible person in Hawaii for defending both State and Federal Constitutions, and their First Amendments in particular, I am asking you to convey this request to Governor Lingle before Thanksgiving, in order to achieve unity on behalf of the Law of the Land, in a bi-partisan call for Roger’s release.

    You must be aware that due process has been suspended in your State. In denying Reverend Christie a fair trial before imprisoning him the foundations of freedom have been suspended by a failed drug war.

    Roger is a dear personal friend and an internationally respected Cannabis cultural ambassador. Reverend Christie has been a productive, progressive community rights activist on the Big Island for more than a quarter of a Century. I trust you will see the importance of prioritizing his release in defense of all our Constitutional rights at this critical time in our social evolution.

    I don’t believe in “bashing” anyone either. But let’s keep it real. For people at the helm of major public funding, entrusted to do everything possible to end Cannabis prohibition, there is such a thing as accountability. NORML has failed and is not helping Roger by falsely characterizing him as a charlatan motivated by profit. He is not, and his ministry has always been one of maximum integrity -not perfect, by Roger’s own admission, but certainly the most legitimate, effective and sincere representation of a Cannabis “religion” in the U.S. so far.

    With all of the money they’ve gotten from people over several decades, NORML has failed to present the strongest arguments there are for ending Cannabis prohibition. Roger is attempting to do that. Not only aren’t our NORML (& DPA/MPP/ASA) “friends” supporting Roger’s First Amendment argument, they are actively subverting it by disrespecting who Roger is, and the victory he’s ALREADY achieving, just in having his (OUR) rights of due process violated. Roger and I have been working brothers for almost twenty years.

    Since we planted Cannabis publicly together on Maui, in ’92, he’s been one of my closest friends, allies, inspirations. I won’t let anyone diminish his incredible achievements, least of all NORML. Here are the two strongest arguments for ending Cannabis prohibition that I can find. Though this information has been out there for years, NORML continues to ignore this information. I intend that the first effect of this enormous, inarguable rationale will be to effect Roger’s immediate release.

    The following has been post to the UNFAO Food security and nutrition forum and mailed as a letter to the editor to the Hawaii Tribune-Herald : What is potentially the most available and complete source of essential nutrition?

    Answer: Cannabis seed.

    Current food security concepts fail to recognize the unique and essential properties of hemp seed. For this reason, they are doomed to continue failing until the shift in values is achieved. Until Cannabis seed is considered objectively and comprehensively, this discussion is incomplete.

    On a broader more ominous scale, “global broiling” by increasing UV-B radiation is increasing, impacting the immune response of all life on Earth. Among other effects of UV-B are the contributing influence of global broiling on the collapse of pollinator populations and insectivores, both of which impact crop production. Exacerbating the problem are the boreal forests being cut and the pine trees dying from global-warming related epidemic pest infestation.

    Among other consequences of losing the boreal forests is the reduction in the amount of atmospheric aerosols called “monoterpenes.” That’s what you smell in a pine forest. Monoterpenes reflect solar radiation away from the planet and seed cloud formation. Aside from being nutritionally complete, unique and essential,Cannabis also happens to produce more monoterpenes than any other food resource, in a shorter span of time in more soil and climate conditions than any other agricultural resource. To solve the food security equation, all organic, rotational solutions need to be implemented immediately, inclusive of Cannabis agriculture, manufacture and trade.

    Presently, the only thing that inhibits the free agricultural market is the very thin misconception that it is difficult to tell industrial hemp from psychoactive strains of marijuana. In fact it is quite easily to distinguish between the varieties, each having distinct physical structure, plant spacing and the presence of pollen-producing males growing among the female hemp flowers.

    Dear Mr. President,

    I trust Aloha Spirit to imbue my request with brotherly love for a friend in which it is written. Mahalo nui loa, Mr. President, for your compassionate, essential consideration of a pre-trial post-Christmas pardon for THC Ministry founder, Reverend Roger Christie.

    Reverend Roger has been extrajudicially imprisoned-without-trial in Honolulu since July 8th. Blatantly ‘false witness’ against an honorable man’s character is all it has taken to dismiss our “First Freedom” without due process.

    Previously honored by his community with the Ho’ omaluhia “Peacemaker” Award, Roger has been denied bail five times, is not allowed visitors, and his trial was postponed until April 2011. Punishment-without-trial is the very thing the Constitution was written to prevent.

    In reality, Roger is being imprisoned for his success in defeating Cannabis prohibition through his on-going Cannabis scholarship, community service and “ganjanomics” pioneering. A peaceful resident of the Big Island for a quarter Century, Roger has been effective in bringing legal actions that have made marijuana enforcement the lowest priority, grounded marijuana eradication helicopters, and effectively mitigated the hard drug epidemic knowingly caused by government-induced scarcity of pakalolo (NIDA1991).

    In essence, common sense and due process are being dismissed in deference to a counter-productive “drug war” waged against a known “strategic resource” (Executive Orders 9280, 10161, 10480, 10998, 11490, 12919), identified by Thomas Jefferson as being “of first necessity to the wealth & protection of the country.”

    I am asking that you grant Reverend Christie release so that the integrity of our Constitution may be restored, and Cannabis inclusive solutions to problems, from drugs to climate change, may begin to be freely considered.

    I would like to start by sending my warmest feelings to Rev Roger. Keep your head up and never give up hope. Jack spent time in jail for the ‘crime’ of rallying for the cause. The great Robert Nesta was shot because “A got the right to choose his own destiny.”

    I myself am an ordained minister and would like to draw your attention to two things: Though you are probably aware the prophet Zarathustra, had a love affair with the Cannabis plant, and it is said Jesus Christ was anointed with Hemp Oil.

    Secondly… The Divine gave us all that is good… If God is for us, who can be against us?

    Roger Christie, deemed “a danger to society”… rubbish , he is a danger to the system that enslaves and keeps humanity ignorant. Don’t waste your time with politicians , because they are are in control of nothing. The judges are bought and paid for.

    Roger is on the right track and the control freaks are TERRIFIED that the rest of the cannabis people will follow suit and stand up for their rights in vast numbers, then the control system will come crashing down, and once the cat is out of the bag, that’s the end.

    To those who may think it’s “not my problem” , it’s just not about cannabis, it is about liberty and it is your problem because we are all losing our freedoms at an alarming rate, hell now it’s illegal in some places to grow a VEGETABLE GARDEN!!!!!!

    The reason Roger Christie is not given a trail or bail is because he’s a US Citizen/person (subject to their laws) and not a people (subject only to god’s laws). Learn the difference and he can be free!

    The November 13, 2001 Presidential Military Order purported to give the President of the United States the power to detain non-citizens suspected of connection to terrorists or terrorism as enemy combatants. As such, that person could be held indefinitely, without charges being filed against him or her, without a court hearing, and without legal counsel. Many legal and constitutional scholars contended that these provisions were in direct opposition to habeas corpus, and the United States Bill of Rights. However in Hamdi v. Rumsfeld (2004)[32] the U.S. Supreme Court re-confirmed the right of every American citizen to access habeas corpus even when declared to be an enemy combatant. The Court affirmed the basic principle that habeas corpus could not be revoked in the case of a citizen.

    Habeas corpus is an ancient remedy whose original purpose was to contest detention by the king. The origins of the writ, or “written order” (its Latin name means, loosely, “produce the body”), can be traced to thirteenth-century England. On June 15, 1215, at Runnymede, in a meadow beside the Thames west of London, the English barons who had banded together to impose legal restrictions on the power of King John forced him to affix his seal to the Magna Carta. One of its curbs on the sovereign’s power reads, in part, “No free man shall be seized or imprisoned…except by the lawful judgment of his equals or by the law of the land.” This was the “Great Writ”—the ancestor of habeas corpus. Although other common-law writs were in force throughout the British empire, only the writ of habeas corpus appears in the United States Constitution. Article 1, section 9, includes this single sentence: “The Privilege of the Writ of Habeas Corpus shall not be suspended, unless when in Cases of Rebellion or Invasion the public Safety may require it.”

    Habeas corpus requires a jailer to produce a prisoner in a court of law so the basis for detention can be reviewed. The Constitution presupposes this right, but its use has been sharply contested during previous wars.

    Reverend Roger Christie : Doctor of the Church, Confessor of the Faith

    “Doctor of the Church” is a title given by a variety of Christian churches, to individuals whom they recognize as having been of particular importance, regarding their contribution to theology or doctrine. Historically, the title “Confessor” is given to those who have suffered persecution and torture for the faith, though not to the point of martyrdom.

    I nominate Reverend Roger Christie for both of those titles, in due consideration of his impeccable adherence to the spiritual doctrine he has demonstrated by the work of his legitimate ministry, even as he remains in prison. After more than three years of indefinite, cruel and coercive imprisonment, without trial or bail, the only redeeming value of Reverend Christie’s illegal imprisonment may be if it is recognized as an historically precedented test of his faith, and an inarguable demonstration of true sincerity.

    Through his imprisonment, Reverend Roger Christie’s consistent good will and compassionate consideration for the personal challenges of those who have trespassed against his spiritual beliefs and his fundamental human rights, has consistently demonstrated the level of human religious integrity sufficient to recognize the essential ideals of faith and humility living in him.

    When the federal prosecutor’s wife became ill with ALS disease and subsequently died, Roger graciously accepted two lengthly delays in the legal proceedings against him, offering prayers for the people facing a horrible situation. It is time to release Reverend Christie to the loving arms of his courageous wife.

    Since Judge Kobayashi has officially recognized the legitimacy and sincerity of The Hawai’i Cannabis Ministry, then releasing Reverend Christie seems like an obvious next step toward a just resolution.
